RallyRally ("we", "us", or "our") operates the RallyRally mobile application (the "App"). This Privacy Policy explains how we collect, use, disclose, and protect your personal information when you use our App.

Your data is stored on servers operated by Cloudflare, with infrastructure primarily located in regions that provide adequate data protection. We implement appropriate technical and organisational measures to protect your data, including:

RallyRally is operated from New Zealand. If you are accessing the App from outside New Zealand, your data may be transferred to and processed in New Zealand and other countries where our service providers operate. By using the App, you consent to this transfer.
RallyRally is intended for users aged 18 years and older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected data from someone under 18, we will delete it promptly.

The RallyRally mobile app does not use cookies. We use local device storage to keep you logged in and cache data for performance. This data remains on your device and is cleared when you log out.
We may update this Privacy Policy from time to time. We will notify you of significant changes by email or through the App. The "Effective Date" at the top indicates when the policy was last updated.

Welcome to RallyRally. These Terms of Service ("Terms") govern your use of the RallyRally mobile application ("App") operated by RallyRally ("we", "us", or "our").
By creating an account or using RallyRally, you agree to be bound by these Terms. If you do not agree, do not use the App.

You may only maintain one active account. We may terminate duplicate accounts.
RallyRally is a platform to connect tennis players for the purpose of arranging matches and games. The App facilitates introductions and bookings but does not supervise, control, or participate in actual meetings or matches.
You agree to use RallyRally only for its intended purpose and in compliance with all applicable laws. You will not:

RallyRally offers optional premium subscription services ("RallyRally Premium") that provide access to enhanced features. Premium subscriptions are available through:
Subscription pricing is displayed at the time of purchase and may vary by region. All prices are inclusive of applicable taxes unless otherwise stated. By subscribing, you authorise us (or our payment processors) to charge your chosen payment method for the subscription fees at the start of each billing period.
You can manage your subscription and turn off auto-renewal at any time:
You may cancel your subscription at any time. Upon cancellation:

We may offer free trial periods for RallyRally Premium. At the end of a free trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. We will notify you before your trial ends.
We may change subscription prices at any time. Price changes will take effect at the start of your next billing period following notice of the change. If you do not agree with a price change, you may cancel your subscription before the change takes effect.
If your subscription lapses (due to cancellation, non-payment, or otherwise):
The App, including its design, features, code, and branding, is owned by RallyRally and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our written permission.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
To the maximum extent permitted by law, we disclaim all warranties, including but not limited to:

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid to us (if any) in the 12 months preceding the claim, or NZD $100, whichever is greater.

You may delete your account at any time through the App settings. Upon deletion, your data will be removed as described in our Privacy Policy.
We may suspend or terminate your account at any time, with or without cause, with or without notice. Reasons may include (but are not limited to):
Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive (including disclaimers, limitations of liability, and indemnification) will survive termination.
If you have an active RallyRally Premium subscription at the time of termination:
We may modify, suspend, or discontinue any part of the App at any time without notice. We are not liable for any modification, suspension, or discontinuation.
We may update these Terms from time to time. We will notify you of material changes by email or through the App. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
Before initiating any formal proceedings, you agree to contact us at hi@rallyrally.app and attempt to resolve the dispute informally for at least 30 days.
These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to conflict of law principles.
Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of New Zealand.
To the extent permitted by law, you agree that any disputes will be resolved on an individual basis, and you waive any right to participate in a class action or class-wide arbitration.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and RallyRally regarding the App.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
You may not assign or transfer these Terms or your rights under them. We may assign our rights and obligations without restriction.
